Welcome to Swahili Teacher Theo (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of swahiliteachertheo.com (the “Site”) and our lessons, courses, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Acceptance of Terms

By accessing or using the Services, you confirm that you can form a binding contract and that you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility & Accounts

  • Minimum age: You must be at least 13 years old (or the age of digital consent in your region) to use the Services.
  • Account info: If you create an account, you agree to provide accurate information and keep it updated. You’re responsible for all activity under your account.
  • Security: Keep your credentials confidential. Notify us immediately of any unauthorized use.

3) Bookings, Payments & Pricing

  • Bookings: Lessons and courses may be scheduled via the Site or approved channels.
  • Pricing: Prices are shown at checkout and may change from time to time. Taxes/fees may apply depending on your location.
  • Payments: Payments may be processed by third-party providers. We do not store full card details on our servers.
  • Confirmation: Your booking is confirmed when we send you a confirmation notice or receipt.

4) Cancellations, Rescheduling & Refunds

  • Student-initiated changes: You may cancel or reschedule within the timeframe stated during booking. Late changes or no-shows may be charged in full.
  • Provider-initiated changes: If we must reschedule or cancel, we will offer an alternative time or a refund for the affected session.
  • Refunds: Where applicable, refunds are issued to the original payment method and may take time to appear depending on your provider.

5) Acceptable Use & Conduct

You agree not to:

  • Use the Services for unlawful purposes or to infringe others’ rights.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Attempt to gain unauthorized access to accounts, systems, or networks.
  • Upload or transmit harmful, misleading, or illegal content.
  • Record or redistribute lessons or materials without prior permission.

6) User Content

You retain ownership of content you submit (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display it for the purpose of providing and improving the Services.

You represent that you have the necessary rights to grant this license and that your User Content does not violate any law or third-party rights.

7) Intellectual Property

The Site, course materials, lesson content, logos, trademarks, and all related intellectual property are owned by us or our licensors and are protected by applicable laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from our materials without written consent.

8) Third-Party Services

The Services may link to or integrate with third-party websites, tools, or payment providers. We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

9) Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or meet your expectations.

10) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid to us for the Service giving rise to the claim in the twelve (12) months preceding the event.

11) Indemnification

You agree to defend, indemnify, and hold harmless Swahili Teacher Theo and its personnel from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, or your breach of these Terms.

12) Suspension & Termination

We may suspend or terminate your access to the Services at any time with or without notice if we believe you have violated these Terms or applicable law, or to protect the security, integrity, or reputation of the Services or our users. Upon termination, provisions that by their nature should survive will survive.

13) Governing Law & Disputes

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-laws rules. Courts located in Dar es Salaam shall have exclusive jurisdiction, unless mandatory consumer protection laws where you reside provide otherwise.

14) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page with a new “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
